TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the services provided by Common Ground Social Network Inc., trading as WeShortlist (“we,” “our,” or “us”). By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”).

By submitting an application through our platform, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy, and you consent to having your application reviewed and assessed using AI technology.

1. Who We Serve

We provide services to two types of users:

  • Candidates – individuals who submit resumes or application materials, either directly or through a hiring manager.

  • Hiring Managers – individuals or organizations who post roles, review candidates, and in some cases, upload candidate resumes for evaluation.

These Terms apply to both user types unless otherwise specified.

2. Our Services

Our platform enables:

  • Candidates to apply for roles and have their applications assessed using AI technology based on criteria set by hiring managers.

  • Hiring managers to post roles, review ranked candidates, and manage the hiring process.

For Candidates – The platform is free to use.
For Hiring Managers – The platform is provided on a per-role paid basis.

3. Pricing, Billing & Refunds

  • Hiring managers are billed up front per role posted.

  • All fees are non-refundable. However, we offer a satisfaction guarantee: if you are unsatisfied, we may issue the value back as a credit toward a future role.

  • All prices are displayed in your local currency (e.g., USD for U.S. customers, CAD for Canada, etc.).

  • Taxes, duties, and other applicable charges may apply based on your jurisdiction.

4. AI-Powered Assessment Consent

By applying for a role through our platform, candidates consent to their application materials being reviewed and assessed by AI technology. This may include automated ranking, scoring, or matching against job criteria.

  • AI assessments are intended to assist hiring managers in identifying potential matches.

  • Hiring decisions are not made by AI. Final decisions are always made by hiring managers or their organizations.

5. User Responsibilities

5.1 Candidates

  • You must ensure that all information you submit is accurate, complete, and lawful.

  • You retain ownership of your resume and application materials, but you grant us a license to process, display, and (in anonymized or aggregated form) use them to improve our services and AI technology.

5.2 Hiring Managers

  • You must ensure you have lawful grounds (including candidate consent) before uploading any candidate resume or personal data.

  • You may only use candidate information for the purpose of hiring for the role it was submitted to.

  • You retain ownership of your job postings and materials, but grant us a license to process and display them on the platform.

  • You must comply with all applicable laws when using the platform, including anti-discrimination and privacy regulations.

  • You may not scrape, resell, or misuse candidate data.

6. Acceptable Use

You may not use the platform to:

  • Upload or share unlawful, discriminatory, harmful, or misleading content.

  • Attempt to interfere with or disrupt the platform’s functionality.

  • Access the platform in a way intended to extract or resell candidate or job data.

  • Engage in any activity that violates applicable laws or infringes on the rights of others.

7. No Guarantee

We do not guarantee that:

  • Candidates will be hired.

  • Hiring managers will find suitable candidates for their roles.

  • The platform will be uninterrupted, error-free, or available at all times.

The platform is a tool to assist in hiring; final decisions rest solely with hiring managers.

8. Service Availability & Updates

We may update, suspend, or discontinue parts of the platform at any time without notice. While we strive for reliability, we cannot guarantee uninterrupted access or that every feature will remain available.

9. Data Use for AI Improvement

We may use candidate and hiring manager data in anonymized or aggregated form to improve our AI models, algorithms, and services. No personally identifiable information is used in this process without explicit consent.

10. Third-Party Services

Our platform may integrate with or rely on third-party services (e.g., hosting, analytics, payment processing). By using our platform, you also agree to comply with any applicable terms of those third-party providers.

11. Account Management & Termination

We reserve the right to suspend or terminate any hiring manager account that:

  • Violates these Terms

  • Engages in fraudulent or unlawful activity

  • Misuses candidate information

We may also remove or reject any candidate application that violates these Terms or applicable laws.

12. Intellectual Property

All content and materials provided through the platform (excluding user-submitted content) are owned by or licensed to us.

You may not copy, distribute, or modify any part of the platform without our written consent.

13. Indemnification

Hiring managers agree to indemnify, defend, and hold harmless WeShortlist and its affiliates from any claims, damages, or expenses resulting from:

  • Uploading candidate data without proper consent,

  • Misuse of candidate information, or

  • Violation of these Terms or applicable law.

14. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

  • Our total liability for any claim under these Terms will not exceed the amount you paid for the service related to that claim (for hiring managers), or $0 (for candidates).

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada.

15.1 Arbitration First

If you have a dispute with us, you agree to first attempt to resolve it through binding arbitration conducted online or in British Columbia, Canada, using an independent arbitrator we mutually select. Each party will bear their own costs unless otherwise awarded.

15.2 Court as Fallback

If arbitration fails to resolve the dispute, you agree that the matter will be handled exclusively in the courts of British Columbia, Canada.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or by posting the updated Terms on our site. Continued use of our platform after changes take effect constitutes acceptance of the new Terms.
